Employment Rights in Abu Dhabi Free Zones

Free-zone employment in Abu Dhabi should be checked against the particular zone and employing entity.

A free-zone job in Abu Dhabi does not automatically fall under a single employment code. Most non-financial free zones operate with the federal Labour Law alongside their own administrative rules, while ADGM has an independent employment framework. Establish the actual employer and licensing authority before comparing leave, notice, wages or dispute procedures.

The UAE Government guidance on recruiting in free zones explains the broad distinction. Free-zone permit administration and the substantive law governing employment are connected questions, but they are not identical.

Collect the signed contract, offer, employer licence name, permit information and any secondment agreement. A brand may operate through several companies. The employer named on your documents may be different from the company whose logo appears on the office door.

Ask which authority issued the employer's licence and your work permission. Identify the contract's governing-law clause and any relevant mandatory framework. Do not assume you can select whichever regime has the most attractive benefit simply because a corporate group operates both inside and outside a free zone.

If assigned to a client, clarify whether the relationship is employment, a secondment or another authorised arrangement. The person supervising daily tasks may not be the entity responsible for wages, benefits or permit administration. An accurate map of those roles prevents complaints being directed only to a client that is not the legal employer.

Non-financial free zones

For many free-zone employers, federal private-sector standards remain relevant alongside zone-specific regulations and processes. The zone authority may administer work permits and residence applications and may provide an initial employment enquiry or dispute channel.

Request the current rules from the particular authority rather than treating a general UAE guide as a complete local procedure. Check how the zone handles offer registration, permit renewal, changes of employer and cancellation. Keep the authority's official service references.

An internal zone procedure should not be confused with permission to reduce a mandatory employee entitlement. Where a contract appears inconsistent with the law, ask the authority to explain the governing rule and complaint route. The correct answer may require both the substantive labour provision and the zone's administrative process.

ADGM has its own employment law

ADGM's Employment Regulations 2024 took effect on 1 April 2025 and replaced the 2019 regulations. Its Employment Affairs Office provides the current legislation, guidance, frequently asked questions and contract templates.

The differences are material. Official ADGM guidance describes vacation leave in working days, a different sick-pay structure and specific maternity and paternity provisions. Federal leave totals should not be copied into an ADGM contract without checking the independent rules.

ADGM guidance also distinguishes employment with an ADGM entity from employment with a mainland entity operating under dual-licensing arrangements. If your contract is with the Abu Dhabi mainland-licensed entity, the existence of a related ADGM business does not itself make the ADGM regulations apply.

Compare the whole employment package

Review salary components, working hours, annual leave, sick pay, family leave, insurance, notice and end-of-service arrangements together. Ask whether a benefit is statutory, contractual or discretionary, and how it is calculated for your employment pattern.

For example, 20 working days of annual vacation cannot be compared with 30 calendar days simply by looking at the larger number. Weekly rest days and public-holiday treatment affect the actual time away. Similarly, a higher total salary does not establish the basic-wage figure used for a particular termination payment.

Check who supplies health insurance and which dependant benefits are included. If a recruiter says a free-zone package is tax-free, fully inclusive or unlimited, request the actual contractual wording. Marketing descriptions do not answer eligibility or payment conditions.

Residence and permits remain separate

An independent residence category does not necessarily remove the need for the employer to arrange the relevant work permission. ADGM specifically addresses permits for employees and temporary permits for qualifying non-employees. Non-financial zones have their own permit administration.

Before changing employer, agree the sequence for notice, final settlement, permit cancellation and the new application. Ask how dependant residence will be handled. A zone's willingness to process paperwork does not automatically resolve a disputed notice period or unpaid wage.

Take a dispute to the correct channel

For an ADGM employment matter, distinguish the Employment Affairs Office's guidance role from adjudication by ADGM Courts and any relevant regulatory reporting. The office expressly says it cannot provide legal advice. Do not assume an enquiry email is a filed court claim.

For another free zone, ask its authority how an employment dispute is registered and whether referral or other steps are needed before the competent court. Keep the response and complaint reference. A private-sector MoHRE process should not be assumed to cover every free-zone administrative situation in exactly the same way.

Where the employer's licence, contract and permit point to different entities, obtain clarification promptly. That factual issue is central to identifying the law and forum. Keep deadlines in view while clarification is sought, especially when termination also affects residence or access to employment records.
