The correct authority for an Abu Dhabi employment dispute depends on the employer and governing framework. Covered federal private-sector disputes normally start with MoHRE. ADGM employment claims use ADGM's framework and courts. Government employment follows the applicable public-sector grievance system. Immigration problems require the immigration authority even when they arise after dismissal.
Before filing, identify the legal employer, work-permit issuer and applicable contract. A complaint submitted to the wrong body may not protect a deadline elsewhere. Use the employment-regulations overview to distinguish the main frameworks before assembling the claim.
Federal private-sector employment
For an employer and employee covered by the federal Labour Law and ministry process, MoHRE examines individual labour disputes and attempts resolution. Current amended Article 54 also permits the ministry to decide qualifying claims not exceeding AED 50,000 and specified disputes concerning non-compliance with a prior ministry settlement.
If the matter is outside the ministry's decision jurisdiction and cannot be settled, referral to the competent court may follow. In Abu Dhabi, court administration and filing requirements should be checked with the Abu Dhabi Judicial Department after the relevant ministry step. Do not assume sending documents to a ministry officer also completes court registration.
A confidential report about delayed salary and a formal claim seeking particular money can serve different purposes. Ask which service has been registered and whether additional steps are needed. Keep the case number and any written referral or decision.
Challenges to a ministry decision
The 2024 amendment changed the challenge forum to the Court of First Instance, replacing the earlier Court of Appeal route. A 15-working-day period applies from notification or announcement of the relevant ministry decision. Where a decision has just arrived, seek procedural guidance immediately instead of waiting for the employer to respond informally.
The current federal limitation for hearing claims under the law is two years from termination of employment. That does not cancel shorter complaint or challenge requirements. Some official overview pages retain older wording; rely on the amended law and current instructions for a live case.
Keep evidence of when a decision was received, including the official notification. An internal email forwarded days later may not establish the legal notification date. Obtain advice if there is a dispute about service or the appropriate deadline.
ADGM employment
ADGM has an independent employment framework. Its Employment Regulations 2024 became effective on 1 April 2025. The Employment Affairs Office provides regulatory guidance and relevant materials, but expressly does not provide legal advice.
Distinguish an enquiry to that office, regulatory reporting and a claim filed with ADGM Courts. They are not interchangeable. Ask about the court process appropriate to the employment claim, required documents, service and any applicable fee or assistance arrangements.
The employer's legal identity matters. A company group may have an ADGM entity and a separately licensed mainland business. ADGM's official guidance explains that employees contracted to the mainland entity in a dual-licensing arrangement are not automatically covered by the ADGM employment regulations.
Other free zones
For a non-financial free-zone employer, check with the relevant free-zone authority. Federal labour standards can remain relevant while the authority administers permits and provides its own initial enquiry or referral procedure. ADGM's independent rules should not be applied to every free-zone employer.
Collect the licence details, contract and permit before asking where to file. If the free-zone authority directs you to another body, request the instruction or referral in writing. Record whether the authority has opened a dispute or merely answered a general question.
Government and domestic-worker employment
Abu Dhabi local government employment should be checked against Law No. 8 of 2025 and its implementing arrangements, effective from 1 January 2026. The employing entity's grievance or objection procedure is distinct from an ordinary private-sector labour complaint. Federal ministries and authorities use the federal government HR framework, subject to any special regulations.
A government-owned commercial company's employees are not necessarily appointed government employees. Read the contract and employer's legal basis rather than classifying the job from ownership alone.
Domestic workers have separate legislation and dedicated MoHRE services. Use the correct complaint category and documents. Do not calculate rights solely from ordinary private-sector entitlements or assume the same procedural details apply.
Split employment, immigration and safety issues
Unpaid wages belong in the employment process; residence renewal, cancellation and overstay questions belong with ICP for the relevant Abu Dhabi record. One employer event can require both processes. Ask each authority what it can resolve and what remains outstanding elsewhere.
Violence, threats or an immediate safety incident may require police or medical assistance in addition to employment reporting. A wage claim cannot replace urgent protection or necessary criminal reporting.
Prepare a short authority checklist: legal employer, employment regime, dispute type, amount claimed, decision or termination dates, and the remedy sought. Use that information when asking for routing advice. Retain every reference number and continue monitoring deadlines while any jurisdiction question is being clarified.
