Understanding Notice Period Requirements in UAE Employment

Notice requirements depend on the employment regime and whether probation or another exception applies.

For ordinary termination under Article 43 of the federal private-sector Labour Law, written notice must be between 30 and 90 days, as specified in the contract. Employment continues during notice and the employee remains entitled to the applicable full wage. Probation, lawful termination without notice and ADGM employment require separate checks.

Do not calculate a departure date from a colleague's experience. Start with the contract, the notice actually delivered and the employment regime. The official termination guide explains the federal rules.

Identify the relevant clause and event

Check whether the employer or employee is terminating, whether the employee is still on probation, and whether the contract is expiring or being ended early. A fixed term does not remove the need to understand the applicable termination procedure. Nor does a verbal conversation necessarily establish every detail of a valid notice.

Notice should identify the decision and intended final date clearly. Use a method that provides a reliable delivery record and send it to the appropriate employer contact. If the company requires a portal submission, keep the receipt as well as the written notice.

Where the contract and handbook conflict, ask which provision applies and how it meets the law. For ordinary federal termination the notice period should be the same for both parties unless the difference benefits the employee. A company policy cannot simply erase statutory protection by using a different label for dismissal.

Working and pay during notice

Unless lawfully agreed otherwise, continue performing the contract during the notice period. Clarify duties, access, reporting and handover. Being told not to attend the office does not necessarily mean the employment end date or pay entitlement has changed.

Ask the employer to distinguish paid release from duties, annual leave, a reduced notice period and immediate termination with compensation. These arrangements have different consequences for attendance records and the settlement calculation. Keep written approval of any agreed change.

The federal guidance explains that failure to serve the required notice can lead to an allowance based on the employee's last wage for the unserved period, even without demonstrated damage. Do not assume an employer can calculate this from basic salary alone, or that any disagreement automatically allows deduction of the entire final salary.

Agreeing an earlier release

Both parties may agree to reduce or waive notice while preserving the relevant rights. Write down the last working day, employment end date, pay treatment and whether either party waives a notice-compensation claim. A brief agreement prevents a later dispute over what a friendly conversation meant.

For example, an employee with a 60-day contractual notice may ask to leave after 40 days. An approval should say whether the remaining 20 days are waived without compensation, paid while released from duties, or settled in some other lawful way. A new employer's desired starting date does not itself settle that issue.

Do not promise overlapping employment without checking work-permit requirements and contractual obligations. Notice arrangements deal with the existing relationship; they do not independently grant permission to work elsewhere.

Time to look for another job

If the employer terminates a federal private-sector contract, the government guidance describes an unpaid absence of one day per week during notice to search for another job. The worker must notify the employer at least three days before the chosen absence.

Record that time under the correct category. It should not be confused with paid annual leave or a general right to stop working whenever an interview arises. Coordinate interview schedules and preserve the notification if attendance is later disputed.

Probation and serious breaches

Federal probation notice differs: an employer ending employment generally gives at least 14 days, an employee leaving the UAE gives at least 14 days, and an employee moving to another UAE employer gives at least one month. Read the probation explanation before applying the ordinary 30-to-90-day range.

Termination without notice is restricted to statutory circumstances and procedures. An employer's allegation of misconduct does not automatically remove the notice entitlement. Likewise, an employee claiming a serious employer breach should obtain advice on the evidence, notifications and legal conditions before leaving immediately. Some employee-initiated exceptions have specific reporting requirements.

ADGM and other employment regimes

Under ADGM's Employment Regulations 2024, official guidance describes a minimum of seven calendar days for probation or service below three months, and 30 calendar days after at least three months' service. Longer contractual notice can apply. The guidance also distinguishes fixed-term expiry and termination for cause, and payment in lieu requires the employee's written consent under the relevant rule.

Government and domestic-worker notice provisions must be checked separately. A free-zone address also requires identification of the actual employer and authority, since ADGM's independent framework is not the rule for every Abu Dhabi free zone.

Before departure, reconcile notice pay, unused leave and other settlement items separately. Confirm the permit-cancellation sequence and your immigration deadline with the competent authority. Serving notice or filing a pay complaint does not automatically perform those administrative steps.
