A federal private-sector labour complaint normally begins with the Ministry of Human Resources and Emiratisation, which examines the dispute and seeks a resolution. Depending on the claim and outcome, MoHRE may issue an enforceable decision or refer the dispute to the competent court. Filing a complaint is a process with evidence, notifications and deadlines, not simply sending a message about an unfair experience.
First confirm that this is the appropriate route for your employer. ADGM, government employment, domestic work and some free-zone administration require their own channels. The MoHRE complaint leaflet identifies official filing channels, including the ministry website, application and Labour Claims and Advisory Call Centre.
Define the problem and the remedy
Write a short chronology with the employment start date, disputed event, relevant pay periods and any termination date. Identify what you want resolved: unpaid wages, an incorrect deduction, unused leave, notice compensation, gratuity or another contractual or statutory right.
Prepare a calculation separating each item. For unpaid salary, show the due month, amount due, payment received and remaining balance. For unused leave, show the days claimed and pay basis. Avoid adding the same loss under several headings or presenting an unexplained total.
An internal attempt to resolve the issue can be useful, but it should not become an indefinite delay. Keep the employer's replies and ask MoHRE about the applicable submission period. Ministerial complaint procedures and later court deadlines are separate, so do not assume one long limitation covers every step.
Gather relevant evidence safely
Keep the contract, offer, work-permit details, payslips, bank payment records, leave statements, notices and correspondence explaining the disputed decision. Provide documents that support the issue rather than sending a large unstructured collection of files.
Use clear filenames and a one-page index if the record is substantial. Where a document is in another language, ask about translation requirements for the relevant stage. A court may require documents in the prescribed format even where an initial ministry enquiry accepted a simple copy.
Do not obtain evidence by accessing another person's account, removing confidential client records or secretly circulating sensitive personal data. Preserve material you are lawfully entitled to hold and seek advice where the proper method of collecting evidence is uncertain.
Register through an official channel
Access the service from MoHRE's official website or application and verify the correct complaint category. Provide accurate identity, employer and contact details. Keep the submission receipt and case number, then monitor the email address and mobile number used for registration.
A general enquiry, a confidential salary report and a registered individual dispute are not necessarily the same service. Ask which process your submission creates, whether a formal claim has been registered and what action comes next.
Respond to requests for documents or calls within the stated period. If you cannot attend a scheduled session, contact the authority promptly through the case channel. Do not assume an unanswered call means the claim has been decided or automatically moved to court.
Understand decisions and settlement
Current amended Article 54 permits MoHRE to decide qualifying disputes where the claim does not exceed AED 50,000, and specified disputes about failure to comply with a previous ministry settlement regardless of value. Cases outside that jurisdiction may be referred to court if no settlement is reached.
If a settlement is offered, read the amount, payment date, release wording and consequences of non-payment. Distinguish wages actually received from a promise of a future instalment. Ask how the settlement is recorded and enforced if the employer does not comply.
An enforceable ministry decision is more than informal advice. Obtain the decision and confirmation of how it was notified. Its notification date can trigger a short challenge period, even while you are discussing payment with the employer.
Use the amended court route
The 2024 amendment changed challenges to the competent Court of First Instance rather than the Court of Appeal. The amended provision gives 15 working days from notification or announcement of the ministry decision to bring the challenge. Obtain immediate procedural guidance if you disagree with a decision.
The current federal court limitation is two years from termination of the employment relationship. Older summaries can still state one year or identify the former court route. Those older descriptions should not be used to plan a live filing. A court referral also brings its own registration instructions and deadlines.
For a disputed or near-expiry deadline, obtain legal advice rather than calculating from an assumed email date. Keep notification evidence and distinguish ordinary calendar days from working days in the applicable provision.
Manage work and residence while the case proceeds
Do not start work for a new employer without the required permission. Ask MoHRE whether a temporary or other permit is available for your circumstances, and follow its instructions about the existing permit. A complaint is not itself permission to abandon attendance obligations.
Track immigration separately with ICP for an Abu Dhabi residence record. A labour claim does not automatically renew residence or suspend every immigration deadline. Keep official case and cancellation records accessible, particularly if you leave the UAE or lose access to the employer's systems before the dispute concludes.
