Understanding UAE Labour Law for Private-Sector Employees in Abu Dhabi

Understand federal private-sector labour law in Abu Dhabi, including contracts, permits, pay, leave, termination and the correct complaint route.

Most ordinary private-sector employees in Abu Dhabi are covered by Federal Decree-Law No. 33 of 2021 Concerning Regulating Labour Relations, as amended, together with its implementing regulations and ministry decisions. It governs matters such as contracts, pay, hours, leave and termination. It does not mean every person employed in Abu Dhabi follows the same rules.

Government employees, domestic workers and employees covered by ADGM's independent framework require separate checking. Establish the legal employer and applicable regime before using a benefits table or bringing a complaint. The government's private-sector employment-law overview describes the scope and main exclusions.

The contract and work permit serve different purposes

A job offer records proposed employment terms; the employment contract establishes the agreed relationship; the work permit authorises the relevant work. Residence permission is another document. A person with family-sponsored or long-term residence may still need the employer's appropriate work permit.

Before starting, compare the offer and contract for the legal employer, job, commencement date, salary components, hours, employment model, leave, probation and notice. Query unexplained differences before signing. Keep your own copy rather than assuming access to an employer's system will remain available after a dispute.

Federal law recognises different working models, including full-time and part-time arrangements. Entitlements may be calculated differently for a non-standard model. Calling someone a consultant does not answer every question about the actual arrangement or authorisation.

Pay needs a clear breakdown

Identify basic salary, allowances and any variable payments. Different rights use different pay bases. A total monthly transfer alone may not be enough to calculate overtime, unused leave at termination or gratuity accurately.

Check when wages are due and how the employer records payment through the applicable approved system. Keep payslips and bank evidence. If payment is short, ask which item was deducted and why; if payment is late, record the due date and each follow-up.

Recruitment and employment costs should not simply be transferred to the employee. A recruiter requesting a payment to guarantee employment or process an employer's permit is a reason to verify the arrangement through official channels. Do not rely on a promise that an improper charge will later be refunded.

Hours and leave have defined limits

The general federal working-time rule is eight hours daily or 48 weekly, subject to permitted variations and exemptions. Overtime has separate limits and compensation provisions. A managerial title should not be treated as conclusive evidence of an exemption without examining the actual legal conditions.

Annual leave, sick leave, maternity leave and parental leave are distinct entitlements. Their qualifying rules, payment stages and documentation differ. An employer's generous annual allowance does not explain how certified sickness or maternity absence will be paid.

For example, a newly joined employee should check probationary sick-pay treatment before assuming the ordinary post-probation entitlement applies. A parent should distinguish paid parental working days from maternity days and nursing breaks. Keeping the categories separate prevents both overclaiming and loss of a valid benefit.

Both sides have responsibilities

Employees should perform agreed work diligently, follow lawful instructions, protect confidential information and comply with safety requirements. Employers must meet legal and contractual obligations and provide the required protections. The law prohibits discrimination, harassment, bullying and relevant forms of violence.

If a task appears unsafe or fundamentally different from the agreed role, document the instruction and raise the concern through an appropriate channel. Do not assume every disagreement permits immediate resignation without notice. Statutory exceptions can require specific evidence and notifications.

When an incident involves danger or violence, prioritise safety and contact the appropriate emergency or law-enforcement authority. An internal HR grievance and a labour claim do not replace necessary medical or criminal reporting.

Ending employment requires a separate calculation

Ordinary notice under the federal rule is generally between 30 and 90 days. Probation uses different notice rules, and dismissal without notice is restricted to specified circumstances and procedures. Get the final date and duties during notice in writing.

At termination, request an itemised calculation of salary, notice, unused leave and applicable end-of-service benefits. Final wages and other entitlements are generally due within 14 days of the contract ending. National pension arrangements or an approved alternative savings scheme can affect which termination benefit applies.

Residence cancellation and any grace period are separate immigration matters. A final settlement should not be mistaken for an immigration-status confirmation, and an immigration cancellation does not establish that all wages have been paid.

Resolve disputes through the current route

MoHRE is the starting authority for covered individual private-sector labour disputes. The law was amended in 2024, including dispute jurisdiction and limitation. Current guidance should therefore be checked against the amended text rather than an original 2021 PDF or a summary retaining older provisions.

Prepare a concise chronology, claim calculation and supporting documents. Use the correct authority if the employer is in a free zone or outside the federal private-sector regime. Ask about immediate procedural deadlines while the dispute is being examined; do not assume a longer court limitation gives permission to ignore a shorter complaint or challenge deadline.
