A probation clause should explain how suitability is assessed at the beginning of employment and fit the rules governing that relationship. Before signing an Abu Dhabi contract, check the employer's legal framework, the proposed period, the assessment process and the consequences of leaving or being released. Probation does not make an employment relationship informal or remove every employee protection.
Identify the governing regime
For employment under the federal private-sector framework, probation is subject to the rules in the current labour legislation, including a maximum of six months. ADGM and government employment use separate frameworks. Check the legal employer and applicable law before copying a notice or benefit rule from a general online summary.
If the contract's wording appears inconsistent with the framework, request an explanation before signing. A company's preferred policy cannot simply replace a mandatory legal rule. The probation rights guide explains the federal rules in more detail; this article focuses on reviewing the clause and practical assessment arrangements.
Check the start and end
Record when probation starts and the stated duration. Ask how the completion date is calculated and how the employer records the outcome. If an offer and contract show different periods, resolve the discrepancy rather than assuming the shorter version will be followed.
Read any reference to extension carefully. In the federal framework, probation cannot simply be extended beyond the statutory maximum, and it should not be restarted by routine renewal with the same employer. If the employer proposes a different legal entity or a changed arrangement, establish the facts rather than relying on a group brand name to decide whether it is the same relationship.
Ask what success looks like
A probation clause may set the period without describing the work needed to pass. Ask for responsibilities, objectives and review dates. These should reflect the role actually offered. A salesperson, engineer and administrator need different evidence of performance, so a generic instruction to meet expectations is not particularly useful on its own.
Agree how progress will be discussed and who can make the decision. Keep notes of training, feedback and agreed improvements. If access to systems, customers or necessary equipment is delayed, raise how that affects the assessment. This is practical performance management, not a claim that every review format is legally required.
Review pay and benefits from the start
Check whether the offered salary applies immediately and which benefits begin on joining. A policy may describe particular eligibility conditions, but do not assume that probation permits withholding any statutory entitlement. Distinguish a contractual incentive from legally required protection, and ask for unclear exclusions to be explained.
Medical cover, leave and expense reimbursement can create urgent questions during a new employee's first months. Read the actual policies and the applicable law. In particular, do not import an ADGM qualifying-service rule into federal private-sector maternity entitlement. The governing regime and the particular benefit must be identified separately.
Read each exit route separately
The federal rules distinguish employer termination during probation, an employee leaving the UAE and an employee moving to another UAE employer. Those routes have different notice requirements. A single phrase such as either party may leave immediately does not adequately explain the applicable process.
Before acting, check which route matches your intention and obtain the correct notice advice. Put notices and acknowledgements in writing. Do not assume that a prospective employer's proposed start date overrides the existing obligation. A new position may also require a separate work-permit or residence process beyond ending the probationary relationship.
Examine repayment language
A contract may refer to recruitment, training or relocation costs if you leave early. Ask what cost is meant, who paid it and what legal basis permits recovery. Employer-to-employer arrangements under particular federal probation rules should not be casually rewritten as a blanket employee debt.
Do not accept an unexplained deduction simply because it appears in a handbook. Recruitment costs, genuine training arrangements and optional relocation advances are different issues. If a repayment clause materially affects your decision, seek clarification or advice before signing. Retain the offer and cost schedules so the commitment can be assessed from actual documents.
Manage the review outcome
Ask for written confirmation of the employer's decision and any agreed change in responsibilities or pay. If the decision is delayed, request clarity rather than assuming that silence answers every contractual question. Keep working arrangements and official records accurate while the matter is addressed.
Where employment ends, organise handover, return of property and a clear final-payment statement. Sign only acknowledgements that accurately describe what has happened. A request to confirm receipt of money deserves particular attention if the payment has not actually been made.
Raise concerns through the correct route
Start with a clear account of the clause, dates and disputed action. Keep the signed contract, relevant policy, feedback and communications. An organised chronology helps an employer or adviser understand the issue without relying on broad claims that probation allows anything.
Use the competent employment authority if the concern cannot be resolved internally. For the relevant federal private-sector relationship that may involve MoHRE; ADGM and government roles need their respective routes. A probation clause should give both parties a workable assessment period while remaining consistent with the framework that governs the job.
