Understanding Abu Dhabi Rental Dispute Resolution Procedures

A rental dispute in Abu Dhabi should be taken to the body with authority over the property and the remedy requested. Under the ordinary local tenancy framework, ADJD's Rental Dispute Settlement Committees handle disputes arising between landlords and tenants. ADGM property cases follow a separate judicial system, so jurisdiction should be checked before filing or paying fees.

Define the disagreement and the outcome sought

Describe the problem in one or two sentences. Is it unpaid rent, an unsupported deposit deduction, a repair failure, disputed renewal terms or a request for possession? Different issues can arise in the same tenancy, but a clear list prevents one from obscuring another.

State the practical remedy you need. A request for money is different from asking to terminate an agreement or obtain an urgent direction. A regulatory complaint about an agent may not produce the refund or possession order sought against the landlord. Identify both the responsible party and the authority able to grant that remedy.

Confirm the property regime

Use the address, unit reference, agreement and registration record. ADJD identifies its rental committees with Law No. 20 of 2006. ADGM covers Al Maryah and Al Reem Islands and provides its own real-property framework and courts. A past Tawtheeq record can require clarification where a transition is relevant.

Do not rely only on the parties' chosen label or an agent's assertion that a dispute belongs in a particular court. Explain the location and contract dates when enquiring. Special accommodation, including employer-linked housing or hotels, may need a different analysis from an ordinary residential lease.

Try a documented resolution where appropriate

Send the other party a short written statement of the issue, relevant dates, supporting documents and requested resolution. Ask for a substantive response. Keep the exchange, including any proposal that resolves only part of the disagreement.

A private attempt to settle should not be confused with a mandatory formal referral. ADJD's current FAQs list rental cases heard by the competent rental committees among the exceptions to its general reconciliation-and-mediation referral requirement. Do not assume every rental claimant must begin through the generic civil mediation route. Check the actual service for the claim.

If settlement discussions occur, record whether agreed actions include payment, inspection, contract closure or surrender. Do not sign a broad release while intending to preserve an unmentioned claim. Ask for clarification before approving wording that covers more than the issue discussed.

Build an organised evidence bundle

Prepare the signed lease and addenda, registration, proof of payment, notices and relevant correspondence. Add the arrival and departure condition records for a deposit claim, or inspection and maintenance reports for a repair claim. Preserve originals and provide readable copies.

Create a chronological index showing the event, date and document reference. Where an amount is claimed, include a calculation that reconciles payments, accepted deductions and the requested balance. Label hypothetical illustrations separately; a claim calculation must reflect the actual tenancy evidence.

Avoid unnecessary personal information about unrelated occupants or colleagues. Redact irrelevant material where appropriate without altering evidence that the authority requires. If a representative submits the claim, confirm their authority and keep the submitted version.

Check filing requirements at the time of application

Use ADJD's current service guide or authorised assistance for the correct rental application. Confirm required documents, translation, identification, fees and any prior demand or notice requirement. Do not assume a historic leaflet supplies every current field or that a general court fee applies to the selected rental service.

ADGM Courts publish separate real-property forms, including one for short-term residential lease claims. Their form selection and procedural guidance should be checked directly for ADGM cases. Copying an ordinary local rental application into that system may leave important requirements unaddressed.

Submission is not the same as acceptance or a decision. Retain the application reference, payment receipt and requests for correction. Respond to document queries promptly and keep contact details accurate so service notifications reach the right person.

Follow the case and preserve deadlines

Read every communication in full, including attachments. Record hearing dates and any document-submission direction. If remote attendance is required, check access through the official channel and report technical problems promptly. Negotiating privately does not excuse ignoring an existing case.

Do not infer an appeal deadline from another type of proceeding or an old article. The decision, amount, route and current rules may matter. If a judgment is unclear or the other party does not comply, ask about the appropriate clarification or enforcement process rather than assuming the original application automatically completes recovery.

Keep the resolution enforceable and complete

A settlement or decision should be assessed against the practical outcome needed. For a refund, retain evidence of actual receipt. For surrender, document possession, keys and related administrative closure. For repairs, retain the work and completion record.

The deposit guide and notice guide explain evidence for common issues. No process guarantees success, but identifying jurisdiction, the remedy and a coherent documentary account avoids many preventable filing and communication problems.
