Abu Dhabi residential tenancy questions start with the property's location, the applicable legal framework and the written agreement. For ordinary tenancies within the local framework, Law No. 20 of 2006 and its amendments govern important landlord and tenant obligations. ADGM properties require a separate check. A rent demand, registration record or notice should be assessed against that framework before anyone pays, signs or vacates.
Identify the authority and the property first
The Abu Dhabi Real Estate Centre, ADREC, publishes local property legislation and regulatory guidance. The Abu Dhabi Judicial Department, ADJD, identifies its Rental Dispute Settlement Committees as the bodies handling disputes arising under the local landlord and tenant framework. Registration and property administration are different functions from deciding a contested legal claim.
Al Maryah and Al Reem Islands are within ADGM's jurisdiction. ADGM operates its own real-property framework, registration services and courts. AccessRP provides lease registration and renewal services for those properties. Do not assume that working outside ADGM, holding a federal residence permit or having previously used Tawtheeq determines the law for a new island tenancy.
Special accommodation also needs care. Hotel accommodation, employer-provided housing and other excluded arrangements may not receive the same treatment as an ordinary private residential lease. Ask what legal category the agreement uses. The phrase “fully furnished” alone does not answer whether a property is a normal residential rental or licensed tourism accommodation.
Read the agreement as a set of obligations
A useful contract identifies the actual landlord, the authorised signatory, the property and the person who will occupy it. Check the unit number against the viewing, payment request and registration record. A representative's job title is insufficient evidence that they can sign, receive money or settle a dispute for the owner.
Review the complete annual rent, payment schedule, security deposit and any separate charges. Record which services are included and who pays utilities, cooling and account-opening costs. An affordable rent can still leave an unaffordable first payment if several annual commitments fall together. Use the household housing-cost guide to separate cash-flow planning from legal entitlement.
Dates deserve their own review. Distinguish the tenancy start, physical handover, rent commencement and expiry. An early access arrangement for furniture may not be permission to occupy. Ask how delayed handover, access cards, parking and missing appliances will be addressed. Keep the inventory and any promised repairs attached to the signed version.
Understand registration without confusing it with consent
Tawtheeq is the local tenancy-registration system for properties within that process. The landlord or authorised manager should explain the registration route and supply the resulting record. Check that names, property details, rent and dates match the agreement. A draft application or screenshot of a payment is not the same as completed registration.
For ADGM property, check AccessRP instead. Its current guidance assigns initiation to the landlord or authorised representative and allows the tenant to review and approve the agreement. Obtain the registered lease documentation and retain access to your own account. Registration should not depend on sharing your UAE Pass password or approving an unexplained authentication request.
An administrative problem does not automatically erase the underlying relationship or all remedies. If an owner refuses to register or correct the record, preserve the signed agreement and payment evidence and ask the responsible authority how the defect affects your next step. Do not rely on an agent's claim that an unregistered tenant has no rights.
Check current rent rules before calculating an increase
The published local tenancy law contains a five percent annual increase mechanism, but that historical baseline must be read with later measures. On 3 June 2026 ADREC announced a temporary change from five percent to zero percent until further notice. The announcement says renewals and new agreements will reference the property's last registered Tawtheeq rental rate.
At this review, that official notice remains published. Before accepting a proposed change, ask ADREC whether the measure continues and how it applies to the specific property and registration. A higher advertised rent or an indicative rental-index figure does not, by itself, establish a lawful increase. The rent-increase explanation separates the current notice, the underlying statute and the evidence needed for a query.
ADGM's AccessRP guidance separately describes a five percent residential increase limit. Do not automatically transfer either regime to the other. If the property is within ADGM and somebody cites the emirate-wide announcement, obtain current confirmation of the applicable instrument from ADGM and ADREC rather than choosing the rule with the preferred result.
Match repairs to the cause and the contract
Under the local law, the starting distinction is between necessary repairs and the minor rental repairs customarily handled by tenants, subject to the relevant agreement. The landlord's handover and repair duties should be considered alongside any contractual allocation. There is no universal small-repair currency threshold established here for every Abu Dhabi home.
Report a fault with the date, location, symptoms and photographs where safe. Separate normal deterioration from accidental damage, building-system failures and servicing tasks. The owner, management company and utility provider may need different information. A maintenance ticket should request a response and an appointment, not merely record that somebody complained.
If repairs are ignored, do not assume you may stop paying rent or subtract a contractor's invoice. The local law provides a route involving committee permission for certain repair-and-deduct situations. Seek directions before creating a second dispute about arrears. Immediate danger needs the appropriate emergency response; a compensation argument can be organised after people are safe.
Treat renewal and early departure differently
The published local law requires written notice two months before residential expiry when either party does not want renewal or wants to amend conditions. Specific eviction grounds can involve additional conditions and different periods. A landlord's own-occupation ground, for example, should not be reduced to a generic two-month message. Obtain advice on the actual ground and the current procedure.
A tenant who wants to leave halfway through an agreed term has a different question. A notice of non-renewal does not automatically create an early break right. Read the break clause, establish whether its conditions can be met and negotiate any surrender in writing. Record the final rent date, charges, keys, registration closure and deposit treatment.
Remaining after expiry can also have consequences. The local law addresses renewal where a tenant stays with the landlord's knowledge and without objection. That is not a reason to ignore notices or assume silence always protects the occupier. Keep correspondence showing what was proposed, accepted or disputed before the expiry date.
Plan a handover that proves what happened
A departure should have an agreed inspection, an itemised condition record and evidence that possession was returned. Take room-wide photographs as well as close-ups. Record appliance condition, meter readings, access cards and keys. Distinguish ordinary use from new damage and identify any item already listed on arrival.
Ask for a written receipt when surrendering keys. Merely moving belongings out may leave disagreement about when possession was returned. Closing a utility account or registration is another administrative step and should be coordinated with the actual handover. Keep final statements rather than relying on an app balance that may later change.
For deposit deductions, request the specific breach, supporting evidence, calculation and remaining balance. A broad “maintenance” label is difficult to assess without the condition record and invoices or estimates. Equally, a tenant should not describe every deterioration as fair wear without checking how it occurred. The evidence should let a neutral decision-maker reconstruct the starting and ending condition.
Use the correct dispute route
Begin with a clear written request to the responsible party. State the property, contract, dates, disputed amount and remedy requested. Attach relevant documents in an organised sequence. An angry message containing many unrelated accusations is less useful than a short chronology with identifiable evidence.
ADJD's rental committees handle local-framework rental disputes. Its guidance also describes a deposit-recovery process, but procedural documents and service requirements should be checked when filing. A property manager's internal complaint, an ADREC regulatory query and an enforceable decision serve different purposes. Ask whether the selected service can grant the remedy you need.
ADGM Courts publish separate real-property claim forms, including a short-term residential lease claim form. Confirm jurisdiction before filing or paying fees. If documents are in different languages, ask which translation and certification requirements apply. Do not invent an appeal deadline from an old online article; the route and time limit depend on the decision and current rules.
Keep an evidence file throughout the tenancy
Create folders for the signed agreement, addenda, registration, payments, condition records, notices and maintenance correspondence. Use descriptive filenames with dates. Retain the original message or email where possible, because a cropped screenshot can omit the sender, attachment or delivery information needed later.
Store identity documents securely and share only what an authorised recipient needs. Keep a backup outside a work account you may lose on leaving employment. If a family member is handling the tenancy while you travel, establish their authority in advance rather than sharing credentials informally.
When comparing advice, identify the property regime, document date and legal question before comparing answers. An old cap, a Dubai notice rule and an ADGM service FAQ can all be accurate in their own contexts while producing the wrong answer for your home. Start with the official source, then ask for a property-specific explanation where the published material does not settle the issue.
Before signing or responding to a demand
Check five things together: who owns or manages the home, which tenancy system applies, what the signed agreement requires, what current official rules say and what evidence supports the proposed action. If one is missing, request it explicitly. That approach helps residents make a considered decision without treating an advertisement, a verbal promise or a general online summary as a final legal determination.
