What Happens If a Landlord Refuses to Return a Deposit?

If an Abu Dhabi landlord refuses to return a rental deposit, ask for a written account and identify the exact balance disputed before escalating.

If an Abu Dhabi landlord refuses to return a rental deposit, ask for a written account and identify the exact balance disputed before escalating. A refusal does not prove that every deduction is justified, but it also does not establish that the tenant has no remaining obligations. The next step should be based on the contract, handover evidence and correct dispute route.

Clarify what “refuses” means

A landlord may expressly reject the refund, propose deductions, say an inspection remains pending or simply fail to respond. Record which situation applies. A request waiting for a final utility statement is different from a claim that the tenant caused damage worth the entire deposit.

Find the original deposit receipt and confirm the recipient. If an agent collected money, establish whether they acted for the landlord and who is now holding it. Do not pursue a utility provider for a tenancy deposit or assume a brokerage fee was refundable security merely because several payments were collected together.

Send one clear final-account request

Identify the tenant, property, agreement, deposit paid and handover date. State the refund already received, if any, and the remaining balance requested. Ask the landlord to identify each deduction with the contractual or legal basis, evidence and calculation.

Attach the documents most directly relevant to the disagreement. If the claimed damage existed at arrival, provide the dated condition record. If the dispute is about rent after departure, provide the surrender agreement and key receipt. This makes the request easier to assess than repeated messages asking only “where is my deposit?”

Set a reasonable requested response date as part of the communication, while making clear that it is your request rather than an invented universal statutory deadline. Keep the sent version and delivery evidence. Use the authorised manager's channel as well where the contract requires it.

Review deductions item by item

Compare any inspection findings with the arrival inventory and maintenance history. A tenant should acknowledge damage they caused while challenging unrelated or unsupported costs. Ask whether a replacement was necessary and how the charge relates to the tenant's obligation; do not assume a new invoice automatically proves liability.

For cleaning or reinstatement charges, read the actual agreement and condition record. If the landlord relies on a signed departure declaration, obtain the whole document. A manager's statement that a charge is “policy” should still be connected to the applicable contract and framework.

Request the undisputed balance separately if only one item remains contested. An agreement to refund part of the money should state whether the remaining claim is preserved. Avoid signing “full and final settlement” wording if that is not the intended outcome.

Preserve evidence after leaving the property

Keep photographs, videos, receipts, inspection reports and message exports in a secure folder. Preserve dates and original files rather than editing images to add labels over important details. A separate index can explain where each photograph was taken.

If you have moved abroad, retain access to the email and telephone number used for the tenancy and any official application. Ask how a representative can act lawfully if needed. Do not give account credentials to an unverified recovery service promising a guaranteed refund.

Identify the appropriate authority

For ordinary local tenancies, ADJD's rental committees handle disputes under Abu Dhabi's landlord and tenant framework. ADJD also publishes a specific guide on recovering a rent deposit. Consult the current service to confirm which procedure matches the facts, required documents, language and fees.

An ADREC enquiry can help with property rules or administrative issues, but a regulatory complaint is not necessarily a money judgment. Explain the remedy sought when asking for help. The rental-dispute procedure guide separates registration, private resolution and judicial recovery.

ADGM properties need the ADGM process. Al Maryah and Al Reem are within its jurisdiction, and ADGM Courts publish separate real-property claim forms. Do not apply an ordinary local deposit leaflet to an island tenancy without checking whether it is the correct route.

Prepare the claim around actual facts

Create a short timeline covering the deposit payment, condition reports, departure notice, inspection, possession return and refund requests. Include the landlord's reason for refusal or state accurately that no reason was provided. Reconcile the amount requested with any deductions accepted.

Ask about service of documents and how the other party's identity and address must be recorded. Filing against the wrong company or an individual who only acted as an employee can create avoidable problems. A procedural enquiry or qualified adviser can help identify the proper respondent.

Follow through after an agreement or decision

A promise to pay is not the same as payment received. Retain the settlement, monitor the agreed date and confirm the transfer securely. If a formal decision is made, check its effect and any next enforcement step rather than assuming recovery happens automatically.

The aim is a documented resolution of the deposit account. Keep separate issues, such as an agent complaint or disputed utility charge, clearly identified. That focus helps both a negotiated refund and any later formal application proceed on evidence rather than conflicting recollections.
