Understanding Rental Contract Renewal Rights and Responsibilities

A rental renewal in Abu Dhabi should confirm both the terms for the next period and the administrative steps needed to record them.

A rental renewal in Abu Dhabi should confirm both the terms for the next period and the administrative steps needed to record them. Do not treat expiry as a reason to ignore correspondence or assume that an unsigned new draft automatically replaces the existing arrangement. Start with the current agreement, applicable property regime and official rules in force at renewal.

Review the existing term before discussing the next one

Find the signed contract and every addendum. Record the expiry date, notice addresses, payment schedule and any renewal wording. Check whether a previous variation changed the dates or rent. A draft stored in an email folder may differ from the version finally approved.

List unresolved repairs, disputed charges and any change in occupants. These issues may need attention alongside renewal, but keep them identifiable. Agreement on the next rent should not inadvertently be described as a settlement of an unrelated deposit or maintenance dispute.

Understand ordinary local notice and continuation rules

The published local tenancy law requires written notice two months before residential expiry where either party wants non-renewal or changed conditions. It also addresses renewal where a tenant remains with the landlord's knowledge and without objection. These provisions should be read with the facts, later measures and any relevant judicial interpretation.

Do not assume that every failure to sign a new paper means the tenant must leave immediately. Equally, do not assume silence always secures another term regardless of a valid notice. Keep the full correspondence showing what was proposed and how each side responded.

A landlord's specific possession ground may involve requirements beyond ordinary non-renewal. If the demand cites own occupation, redevelopment or breach, ask for the actual basis and supporting information. The landlord notice guide explains why these categories must not be reduced to one generic deadline.

Check current rent measures

An older five-percent summary is not sufficient to assess a current local renewal. ADREC's 3 June 2026 announcement temporarily changes the annual increase to zero until further notice and refers to the property's last registered Tawtheeq rental rate for renewals and new agreements.

Confirm whether that measure remains operative for the property and transaction. Ask for the previous registered record and an explanation of any proposed new charge. A higher indicative market rent does not automatically authorise the change. If the parties disagree, seek the relevant authority's directions rather than treating an index screenshot as a judgment.

Separate ADGM renewal procedures

Al Maryah and Al Reem are within ADGM's jurisdiction. AccessRP's current guidance describes landlord-initiated renewal, tenant review and approval, and a separate residential increase limit. An ordinary local Tawtheeq renewal process should not simply be copied into that system.

Check any transitional issue and the actual registered lease. ADGM's electronic renewal window is an administrative feature, not a substitute for understanding the legal effect of notice, expiry or possession. Ask the responsible authority when different official materials appear to address the same property differently.

Compare the complete proposed agreement

Review every altered clause, not just the annual rent. Changes to instalments, utility responsibility, repair allocation, parking, access or early departure can materially affect the arrangement. Ask for a comparison or mark the changes yourself before approving the final version.

If a promise is important, include it in the signed documents. A discussion about repainting or replacing an appliance should identify the agreed work and timing. Do not sign a broad statement that all earlier obligations are settled while relying on a verbal promise that they remain outstanding.

Verify the payee before issuing replacement payment instruments or transferring funds. A change of manager or owner may be genuine, but updated bank details should be authenticated through a trusted route. Keep receipts and an account of which payments cover each period.

Complete the administrative record

Agree who initiates the renewal registration and provides the final document. Check the tenant and landlord details, unit, amount and term before approval. Retain the completed record rather than only a screenshot of an application in progress.

Coordinate any utility-account or occupant updates required by the relevant system. A registration error can continue into another service, so query it promptly. Keep the application's reference and correction history if the agreement and official record temporarily differ.

Resolve disagreement before it becomes a deadline crisis

Send a focused written response stating what is accepted, what remains disputed and what information is needed. Keep current obligations under review while seeking directions about a disputed renewal. Unilateral rent withholding or an assumed early exit can introduce additional issues.

ADJD's rental committees handle relevant ordinary local tenancy disputes; ADGM has its own courts and property process. Prepare the agreement, registration, notices and proposed changes if formal help is needed. A successful renewal leaves both sides with the same clear understanding of the next term, the outstanding work and the records that show what was agreed.
