Residential tenants in Abu Dhabi have rights concerning the agreed use of their home, the landlord's obligations and access to a dispute process. Those rights depend on the property regime and facts of the agreement. A useful starting point is to match a specific problem with the contract, current official rule and evidence showing what happened.
Establish which tenancy framework protects the home
ADREC publishes the local landlord and tenant law, Law No. 20 of 2006 with amendments. ADJD's rental committees consider disputes within that framework. ADGM properties on Al Maryah and Al Reem Islands use a separate system. The tenant's nationality does not, by itself, turn an ADGM property into an ordinary local tenancy.
Some accommodation categories are excluded from the local law. Employer housing, hotels and other special arrangements need their own assessment. Ask for the agreement's legal category if the accommodation provider claims that ordinary tenant protections do not apply. A label on an advertisement is insufficient to settle that question.
A suitable home and meaningful use
Under the local law, the landlord should hand over premises fit for the agreed purpose. Significant defects can raise questions about repair, reduced usefulness or termination remedies. The right response depends on the defect and the legal procedure, not simply on how frustrating the problem feels.
Create a dated arrival record before furniture obscures surfaces. Test the fixtures safely, list missing items and send the record to the landlord or authorised manager. If an appliance was promised, preserve the written promise and identify it in the inventory. This is more useful than saying months later that the home was “not as advertised”.
If a serious defect appears later, report the symptoms promptly and request an inspection. Avoid making an unsupported technical diagnosis. A qualified report showing where water entered, for example, helps separate a building defect from damage attributed to the tenant.
Repairs and the limits of self-help
The local law distinguishes necessary repairs from customary rental repairs and allows for the relevant agreement. Ask the landlord to identify the clause relied on when refusing responsibility. A management company's internal spending limit is not automatically the legal allocation between owner and tenant.
A tenant should not assume that a repair complaint permits rent withholding or unilateral deduction. The statute describes committee permission for certain repair-and-deduct situations. Seek the appropriate direction before paying a large contractor invoice and removing it from rent. Emergency safety action and recovery of its cost are separate questions.
Current rent and renewal protections
A proposed increase must be checked against current measures rather than an old summary of the cap. ADREC announced a temporary zero-percent increase on 3 June 2026, until further notice, with the last registered Tawtheeq rate serving as the reference for renewals and new agreements. Confirm current implementation for the property before accepting a revised amount.
The published local framework also contains written notice requirements when either side wants non-renewal or altered conditions at residential expiry. Specific eviction grounds have further conditions. A tenant is entitled to question whether a demand follows the correct route without assuming that every demand is invalid. The landlord notice explanation helps identify what to check.
Ownership changes and payment evidence
The local law addresses continuation of the lease when ownership changes. A sale is therefore not a reason to discard the existing agreement or pay an unknown person immediately. Ask for evidence of the transfer and instructions from an authenticated source before changing the recipient of rent.
Retain receipts for advance payments, the security deposit and other amounts. If the new owner disputes an earlier payment, the date and payee can be crucial. Never pay twice merely because two parties each claim that the other must refund the first payment. Ask the appropriate authority how to preserve your position.
A fair opportunity to challenge deductions
When a deposit is retained, request a written account identifying each alleged breach, supporting evidence and the amount deducted. Compare this with the signed inventory and departure record. A deposit receipt proves that money was paid; condition evidence helps establish whether any deduction is justified.
Tenants also have responsibilities. Damage, unpaid sums or unauthorised alterations can create legitimate claims. A strong challenge recognises agreed facts and disputes specific unsupported items. Request the undisputed balance separately if only part of the deduction remains contested.
Access to an appropriate remedy
For a local tenancy dispute, ADJD's rental committees are the relevant judicial starting point. ADREC property enquiries and registration support may resolve administrative issues but do not automatically produce an enforceable award. ADGM Courts provide a different process for property within their jurisdiction.
Before filing, organise the contract, registration, payments, notices, inspection records and correspondence. State whether you need money, repairs, a decision about termination or another remedy. Keep meeting notes and any settlement in writing. The tenancy-law overview explains how these protections work alongside the tenant's continuing obligations, including rent and proper use of the home.
